By placing an order through SmokeShops+, you agree to be bound by the terms and conditions set forth by the smoke shop, head shop, or vape shop from which you are ordering. SmokeShops+ is not responsible for any issues that arise from the sale, delivery, or pick-up of any products or services.
11. Review/Feedback Policy
    1. SmokeShops+ encourages users to leave reviews and feedback on the smoke shops, head shops, and vape shops listed on our website. However, SmokeShops+ reserves the right to remove any reviews or feedback that violate our Terms of Service or that we determine to be fraudulent, spam, or otherwise inappropriate.
12. Indemnification and Release

13. Dispute Resolution

SmokeShops+ will attempt to resolve the dispute within 30 days of receipt of the notification. If SmokeShops+ is unable to resolve the dispute within 30 days, either party may proceed to arbitration.
    3. Agreement to Arbitrate

You and SmokeShops+ agree that any dispute or claim arising out of or relating to these Terms, Additional Terms, and Privacy Statement, or the breach, termination, enforcement, interpretation or validity thereof, shall be resolved by binding arbitration. The arbitration will be conducted in accordance with the rules of the AAA, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
    4. Exceptions to Arbitration Agreement
       1. Notwithstanding the foregoing, either party may bring an individual action in small claims court. You and SmokeShops+ agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and SmokeShops+ waive any right to a jury trial.
    5. Arbitration Rules and Governing Law
       1. The arbitration shall be conducted by a single arbitrator in accordance with the rules of the AAA. The arbitration shall be held in the United States county where you reside or at another mutually agreed location. The laws of the State of California, without regard to its conflict of laws principles, will govern these Terms, Additional Terms, and Privacy Statement, as well as any dispute that might arise between you and SmokeShops+.
    6. Jury Trial Waiver
       1. You and SmokeShops+ acknowledge and agree that we are each waiving the right to a trial by jury as to all arbitrable disputes.
    7. No Class Actions or Representative Proceedings
       1. You and SmokeShops+ agree that any disputes will be conducted only on an individual basis and not in a class, consolidated or representative action.

    1. This Agreement shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to these Terms or SmokeShops+ shall be filed only in the state or federal courts located in Los Angeles County, California, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.
17. Entire Agreement
    1. These Terms, together with the Privacy Policy and any additional terms to which you agree when using particular elements of the SmokeShops+ platform, constitute the entire agreement between you and SmokeShops+ with respect to the use of the platform.
18. No Waiver
    1. No waiver of any provision of these Terms by SmokeShops+ shall be deemed a further or continuing waiver of such provision or any other provision, and any failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision
19. No Third-Party Beneficiaries
    1. You agree that, except as otherwise expressly provided in these Terms, there shall be no third-party beneficiaries to these Terms.
20. Support or Maintenance
    1. SmokeShops+ is not obligated to provide any support or maintenance for the SmokeShops+ platform.
21. United States Export & Foreign Assets Control Regulations
    1. The SmokeShops+ website and services may be subject to United States export control and economic sanctions laws, and the user agrees to comply with all such laws and regulations. The user represents and warrants that they are not located in, under the control of, or a national or resident of any country or territory that is subject to a U.S. government embargo or sanction, or that is identified on the U.S. Treasury Department’s list of Specially Designated Nationals and Blocked Persons or any other similar list maintained by the U.S. government.
22. Severability
    1. If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Any failure by SmokeShops+ to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
23. No Right of Survivorship and Non-Transferability
    1. The user’s account with SmokeShops+ is non-transferable and any rights to the user’s account or content within their account terminate upon their death. Upon receipt of a copy of the user’s death certificate, the user’s account may be terminated and all content deleted. Furthermore, the user acknowledges that their account is their personal property and that they have no right of survivorship.

    1. The headings and captions in these Terms of Service are for convenience only and shall not affect the interpretation of these Terms of Service.
